Deterrence - Financial Services
Contribute to high profile cases which regulate Australia’s financial market
The Financial Economy Group within ASIC is committed to protecting investors and consumers and increasing market integrity. Within this Group, Deterrence teams are responsible for undertaking major investigations, civil actions and prosecutions to enforce the law and drive behavioural change.
The Financial Services team investigates and litigates within the financial services sector. This may result in banning of individuals or entities, winding up illegal schemes, helping investors recover funds and pursuing criminal action in relation to fraud, theft or misleading conduct.
If you are an experienced criminal and civil lawyer, and have a background in financial services, then this could be your opportunity to work on a variety of high profile matters as you: - Work with and advise investigation teams; particularly regarding the evidence required to prove contraventions of relevant legislation, the admissibility of that evidence in Court and the use of ASIC's investigation powers (including search warrants).
- Ensure adequate and timely resourcing of investigations, where appropriate, and direct staff on activities required to be completed on a matter.
- Commence and conduct civil litigation (in consultation with ASIC Litigation Counsel), prepare briefs to counsel and, where appropriate, recover costs of litigation on behalf of ASIC.
- Compile criminal briefs for the DPP.
- Liaise with key stakeholders (i.e. DPP, police, witnesses, liquidators and administrators, accountants, external lawyers and counsel, and other government agencies) to gather evidence and ensure all stakeholders are kept updated on the investigation.
This 12 month, non-ongoing (contract) role is located in Sydney.
