Be at the forefront of a new regulatory regime
The Real Economy Group is ASIC's key public interface, responsible for public enquiries, as well as receiving, assessing and in some cases, investigating reports of misconduct, and for handling applications and requests for information.
A newly formed Compliance and Deterrence team sits within the Real Economy Group and is tasked with investigating and responding to misconduct and breach reports made to ASIC to ensure appropriate regulatory responses in line with ASIC's internal policies, procedures and regulatory focus. The Compliance and Deterrence team will also take regulatory action against lenders and providers of consumer credit broking services once the credit regime transfers to ASIC from 1 July 2010.
With the goal of securing ????? ????? for various stakeholders through surveillance, compliance, investigation and prosecutions activities, this position will be part of the new Compliance and Deterrence team. The Compliance and Deterrence team will work closely with other Real Economy teams, Registry Services and Licensing and Stakeholder Services.
If you are a criminal or administrative lawyer, and have a background or knowledge of investigations or credit or financial services compliance, then this could be your opportunity to lead the way as part of a new team working on a variety of high profile, high volume matters as you:
- Take instruction from the Team Leader in respect of the delivery of effective regulatory outcomes including the assessment, review, and investigation of matters referred to the Compliance and Deterrence Team.
- Compile routine briefs of evidence where required for successful criminal and/or administrative actions to occur – this may also include attendance in court to give evidence.
- Recommend potential outcomes of investigations including potential (and appropriate) appropriate regulatory actions to be taken by ASIC.
- Liaise with internal and external stakeholders regarding matters under investigation/prosecution.
- As required and instructed, conduct legal research and prepare advice on a range of issues relating to the assessment of matters involving the Corporations Act, ASIC Act, proposed National Consumer Credit Protection Act (2009) and other relevant legislation.
